Terms of Service

Welcome to ArtBoost, the artist marketing program operated by Xanadu Gallery. These Terms of Service ("Terms") explain the rules and expectations for using the ArtBoost website, applying to the program, and participating in our marketing services. By accessing the site or joining the program, you agree to these Terms and to our Privacy Policy.

1. Program Overview

ArtBoost gives artists direct access to the proven marketing system we use at Xanadu Gallery, including listings on XanaduGallery.com, featured email newsletter placements, targeted Facebook and Instagram advertising campaigns, and opportunities for in-gallery exhibitions in Scottsdale, AZ. All participation is subject to application review and ongoing compliance with these Terms.

2. Eligibility

To apply or participate you must:

  • Be at least 18 years old and capable of entering into a binding agreement.
  • Provide accurate, complete information in your application and maintain current contact and billing details.
  • Own the rights to the artwork, images, and content you submit.

ArtBoost is open to artists in the United States and internationally. Acceptance into the program is at the discretion of Xanadu Gallery and may be revoked if eligibility requirements are not met.

3. Account & Portfolio Content

You are responsible for all content you provide, including artwork images, descriptions, biography text, and pricing. By submitting content, you grant Xanadu Gallery a non-exclusive, royalty-free license to display, reproduce, adapt, and promote that content in connection with ArtBoost marketing campaigns, including on websites, email newsletters, social media, and paid advertising channels. You represent that your content does not infringe the rights of any third party and complies with applicable laws.

4. Marketing Services

Once accepted, ArtBoost delivers a suite of marketing activities designed to increase visibility and collector engagement:

  • Dedicated Profile: Your artwork is showcased on XanaduGallery.com with a dedicated artist page to build trust and credibility.
  • Email Promotion: We feature your work in email newsletters sent to qualified collectors who have purchased from us before.
  • Social Media Advertising: Our team produces and manages video ad campaigns targeting collectors on Facebook and Instagram using refined audience profiles.
  • Gallery Opportunities: Top-performing ArtBoost artists may be invited to exhibit in our Scottsdale, AZ gallery.

We may adapt or adjust campaigns based on performance data, market conditions, or platform guidelines. While ArtBoost is designed to expand your reach, we do not guarantee specific outcomes such as sales volume, leads, or social media growth.

5. Pricing and Billing

All plans begin with a one-time $145 setup investment to build your profile page and produce your first video advertisement. Monthly subscription fees (Growth: $95, Expanded: $145, Ultimate: $195) commence only after your campaign launches. Subscription charges recur automatically each month until cancelled. You authorize us and our payment processors to store your payment method and charge it according to your selected plan.

6. Cancellation and Pausing

You may cancel your subscription at any time through your dashboard or by contacting us at artboost@xanadugallery.com. Cancellations take effect at the end of the current billing period. Setup investments are non-refundable once work has begun. We reserve the right to suspend or terminate your participation for unpaid invoices, policy violations, or conduct we deem harmful to collectors, staff, or the ArtBoost community.

7. Collector Leads and Sales

Collector inquiries originating from ArtBoost campaigns may be routed through Xanadu Gallery. Sales facilitated by Xanadu Gallery are subject to separate consignment or sales agreements, including applicable commissions and fulfillment responsibilities. Artists are responsible for timely communication with interested collectors and for providing accurate inventory and pricing information.

8. Intellectual Property

All site content, marketing materials, templates, and campaign assets created by Xanadu Gallery remain our intellectual property. You may not reproduce, distribute, or publicly display those materials outside the scope of your ArtBoost participation without written permission. You retain ownership of your own artwork and grant us the limited license described in Section 3.

9. Acceptable Use

You agree not to misuse the site or services, including by:

  • Uploading unlawful, defamatory, obscene, or infringing content.
  • Attempting to access another user’s account or non-public systems.
  • Interfering with the operation of the site or engaging in fraudulent activity.
  • Misrepresenting your work, credentials, or relationship with Xanadu Gallery.

Violations may result in immediate suspension or termination without refund.

10. Disclaimer of Warranties

ArtBoost is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that marketing campaigns will produce specific results, that the site will be uninterrupted, or that errors will be corrected immediately.

11. Limitation of Liability

To the maximum extent permitted by law, Xanadu Gallery and its directors, employees, and agents will not be liable for any indirect, incidental, consequential, or punitive damages, including lost profits, lost opportunities, or loss of goodwill, arising from your use of ArtBoost. Our total liability for direct damages will not exceed the amounts you paid to ArtBoost in the six months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Xanadu Gallery, its owners, employees, and contractors from any claims, damages, liabilities, costs, and expenses (including legal fees) arising from your content, your use of the services, or your violation of these Terms.

13. Changes to the Program or Terms

We may modify ArtBoost offerings, pricing, or these Terms at any time. When material changes occur, we will post the updated Terms on this page and, when appropriate, notify you directly. Continued participation after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes arising from ArtBoost or these Terms will be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction.
